Car Wreck
If you have ever been involved in an automobile collision, you already know the impact it can have on your life. However, you are not alone and we are here to help. There are over 6 million car accidents each year in the United States. A person is injured in a motor vehicle accident every 10 seconds in the United States, and someone is killed every 12 minutes. In Texas alone, approximately 2000 people die in auto accidents each year. Car accidents are the leading cause of acquired disability nationwide. As adjusters representing injured people, we study many factors that can cause an auto collision. Speeding, driver fatigue, weather conditions, driver distraction and intoxication caused by drugs or alcohol, are just a few examples. In recent years, text messaging and the use of cell phones while driving have greatly increased the danger on our roads and highways. Numerous contributing factors can make an automobile injury claim complicated.

At My Claims, we work hard to protect the legal rights of clients injured in auto accidents. Every day we consider and weigh many complicated legal issues. For example, a single accident can require compliance with several important legal time deadlines. Every day, our trained adjusters and staff navigate a virtual insurance mine field to protect our clients. While our adjusters place particular significance on the importance of an initial investigation into the facts of a car crash, we also deal with issues such as alternative legal theories, the best way to document a client’s injuries and the impact on their day to day life, tax consequences of client recoveries, complying with all legal time deadlines and deadlines and notice requirements in insurance policies, payment of medical bills and the importance of complying with regulations to maintain Medicare and Medicaid coverage for our elderly clients.

Sadly, many people don’t realize the fact that insurance adjusters work for the insurance companies and not for people hurt in a car wreck. Often adjusters will make offers at a very early stage of an auto injury claim - sometimes even hours after a car accident. They make these offers before the full extent of a person's injuries are known. The insurance company's goal is to give the injured person as little money as possible. Insurance adjusters are paid to minimize the value of claims, not to advise people about their rights.

Each state has its own laws regarding the types of damages that are recoverable from an auto accident. In Texas, for example, a person injured by the carelessness of another has a right to compensation for pain and suffering or loss of quality of life, reimbursement for medical bills and lost wages incurred due to the accident, and in some cases punitive damages. There are many different sources of possible recovery for people hurt in car crashes, and it is important that they are all identified. Examples of such sources of recovery include: auto liability insurance, resident relative automobile insurance, medical payment coverage on auto policies, umbrella coverage, health insurance and disability insurance to name a few.

Here are some basic facts. In the United States, alcohol is involved in approximately 40% of fatal auto accidents and 10% of all auto accidents. The loss of lives caused in part by people driving drunk is stunning. Over 17,000 lives are lost each year in the United States due to alcohol-related auto accidents. That translates to an average of one alcohol- related fatality every 32 minutes. Speeding alone is a contributing factor in 29% of all fatal crashes. Excessive speed is the second most common cause of deadly auto accidents, which accounts for 30% of all fatal accidents. Car accidents are the leading cause of death for kids between 2 and 14. Each year, approximately 250,000 children are injured in car crashes, meaning nearly 700 kids are harmed every day.

Our adjusters at My Claim deal routinely with all types of client injuries, such as broken bones, herniated discs, the psychological impact of scarring and the importance of scar revision, head and closed head injuries, back injuries, to name a few. Yet, there is no doubt that even "soft tissue injuries," such as a simple muscle tear, bulging discs or pinched nerves can be very serious, time consuming to treat and debilitating. Pain from these so-called soft tissue injuries can last for extended periods of time, resulting in physical activities being extremely limited. In many instances, there are relapses or even pain and difficulties from these injuries that can last a lifetime. Injuries and symptoms must be properly diagnosed and treated so that injured people receive all the necessary medical attention that they need. It is also important to provide a written record documenting all injuries in order to prove them.
Additionally, people hurt in auto accidents do not always realize that even if the responsible party was uninsured or underinsured, a right to make a claim can still exist under uninsured motorist coverage. Some of our clients are not initially aware that they may have a claim against a responsible party who was intoxicated, even if the property damage or injuries appear to be minor. People who are hurt in auto accidents that occur while on the job may have a third party claim in addition to a claim for workers' compensation benefits. These are just a few of the examples that illustrate why it is vital to hire an adjustment firm who can tackle these issues, fight hard for your rights and protect your interests.
