Truck Wreck

In recent years, there has been a dramatic increase in the number of tractor-trailers (semi trucks or big rigs) on US roadways. Concurrently, there has also been a significant increase in accidents and fatalities related to these tractor-trailers.

​According to Traffic Safety Facts reported by the National Highway Traffic Safety Administration, one out of nine traffic fatalities in 2007 resulted from a collision involving a large truck. Large trucks are defined as those with a gross vehicle weight rating greater than 10,000 pounds. In 2007, 413,000 large trucks were involved in collisions in the USA and 4,584 of them involved fatal crashes. Over 4800 people died in those crashes and another 101,000 were injured. Of those fatalities, 75% were occupants of another vehicle.

  • Running out of the travel lane, either into another lane or off the road (32 percent)

  • Vehicle loss of control due to speeding, cargo shift, vehicle systems failure, poor road conditions, or other reasons (29 percent)

  • Rear-end collision with another vehicle in the truck’s travel lane (22 percent).

  • Factors that can contribute to the above include a badly maintained truck, unsafe operation by the truck driver, an inexperienced truck driver, mechanical failure and truck driver fatigue.

  • Truck driver fatigue is the exhausted, sleepy, or tired feeling a driver experiences while operating a commercial motor vehicle. Long hours, tight deadlines and schedules all contribute to this condition and can result in impaired judgment of the truck driver behind the wheel.

The NHTSA, Fatality Analysis Reporting System (FARS), and the University of Michigan Transportation Research Institute (UMTRI) gathered data on the relative risk per hour of sleep deprivation in fatigue-related truck accidents. The conclusion was that for every hour of sleep deprivation the chances of a truck driver being involved in an accident increased as evidenced by:

Overloaded trucks are another cause of traffic collisions and make driving, controlling, and braking a truck even more difficult. Overloaded trailers, shifting loads or trucks improperly loaded can cause problems such as flying debris, difficulty stopping or controlling the truck and jackknifing or overturning. Jackknifing and rollovers are not as common as other types of truck accidents, but they can result in injuries that are more critical to the driver or other motor vehicle operators as well as significantly more damage to the vehicle.

It is important to remember that insurance adjusters work for the insurance companies and not for the victims of auto accidents. Often adjusters will make offers at a very early stage in a claim - sometimes hours after the accident. They make these offers before the full extent of the injured person's injuries are known. The insurance company's goal is to give the victim as little money as possible. Insurance adjusters are paid to minimize the value of victims' claims, not to advise victims of their rights. While we all understand injuries like broken bones and scars, there is no doubt that even "soft tissue injuries," such as muscle tear, bulging discs or pinched nerves can be very serious and debilitating. Pain from these so-called soft tissue injuries can last for extended periods of time resulting in physical activities being extremely limited. In many instances, there are relapses or even pain and difficulties from these injuries that can last a lifetime. Injuries and symptoms must be properly diagnosed and treated so that an injured person gets all necessary medical attention that they need and to provide a written record documenting those injuries.

Each state has its own laws regarding the types of damage that are recoverable in an auto accident. In Texas, for example, a person injured by the carelessness of another has a right to compensation for pain and suffering, reimbursement for medical bills and lost wages incurred due to the accident, and in some cases punitive damages. There are many different sources of possible recovery for auto accident victims, and it is important that they are all identified. In trucking cases, it is important to also investigate the causes of the trucker’s negligence including mechanical failure, fatigue or road conditions as well as investigating the claims history of the trucking company to determine if the company itself has failed to maintain safety standards.

Statistics show that large trucks were much more likely to be involved in fatal multiple-vehicle crashes than were passenger vehicles. Truck accidents almost always result in serious injuries to the occupants of the automobile(s) involved oftentimes simply due to the difference in weight in the vehicles.

The Federal Motor Carrier Safety Administration (FMCSA) and the National Highway Traffic Safety Administration (NHTSA) of the U.S. Department of Transportation (DOT) conducted a study of the cause of accidents involving large trucks. The Large Truck Crash Causation Study (LTCCS), released in 2006 and updated in 2007, concluded that the following were the three main critical events that cause most truck crashes:

  • After one hour of driving there were 102 fatigue related accidents out of 10,412 = 0.98%

  • After two hours of driving there were 94 fatigue related accidents out of 5,947 = 1.58%

  • After four hours of driving there were 68 fatigue related accidents out of 3,028 = 2.26%

  • After eight hours of driving there were 48 fatigue related accidents out of 1,668 = 2.88%

  • After eleven hours of driving there were 9 fatigue related accidents out of 94 = 9.57%

  • After twelve hours of driving there were 10 fatigue related accidents out of 115 = 8.70%

  • After thirteen hours of driving there were 8 fatigue related accidents out of 32 = 25%
